They are generally applied to incompetent people or people rendered unable to make decisions for themselves due to alcohol or drug abuse. For someone to be appointed the conservator of another person's estate, the conservatorship must be granted by Probate and Family Court.

A guardianship is the appointment of a person to make decisions of a person and that person's estate. In addition to the powers of a conservator, a guardian also takes care of his or her ward on a daily basis. The process of establishing a guardianship may involve working with or against the Department of Social Services. If the Department of Social Services has removed a child from the house of a relative, and you would like guardianship of the minor, you must go to Probate and Family Court for guardianship.
