Child support - The state of Massachusetts has developed and follows very stringent statutory guidelines regarding child support. There must be very specific reasons for the court to deviate from those guidelines such as a parent living out of state or a shared parenting agreement. I represent custodial or non-custodial parents residing in Massachusetts and elsewhere.
Property division - Massachusetts is not a community property state which means if you are getting a divorce the standard for property division is equitable, but not equal. The court considers 14 factors in dividing property including the length of marriage and the financial contributions and conduct of the parties involved. Extra marital affairs are usually not considered. If not done properly, the ramifications of property division may negatively affect tax and inheritance issues.
Parenting plans - The ultimate goal is to create a plan that involves both parents, provides flexibility, and ensures that the children's needs are met. Ideally the parents come together and draft a plan for the court to approve. If the parents can't come to an agreement, a judge who does not know you or your children, will end up making decisions about your life.
